1. Introduction and Acceptance

These Terms of Service ("Terms") govern your access to and use of the Hard Money Lenders of Myrtle Beach website (the "Site") and related services (the "Service"), which are operated by Lead Skills, LLC ("we," "us," or "our"). By accessing or using the Site, submitting an inquiry, or otherwise interacting with the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Site.

2. Our Role: Lead Generation Service

The Service is a lead generation service. Our role is limited to collecting information from consumers interested in hard money financing and connecting those consumers with one or more participating hard money lenders.

We do not make loans, extend credit, take loan applications, issue loan commitments, set rates or terms, or make any credit decisions. All credit decisions, loan programs, rates, fees, terms, funding timelines, and funding itself are the sole responsibility of the participating lender with whom you choose to engage. Any loan you ultimately obtain is a contract between you and that lender, not with us.

3. No Offer or Solicitation

Nothing on the Site constitutes an offer to lend, a commitment to lend, a solicitation for a loan, or an offer of any other financial product or service. Content on the Site is provided for general informational purposes only and is not intended as financial, tax, legal, or investment advice. Submitting an inquiry does not guarantee that you will be matched with a lender or receive a loan offer.

4. Eligibility

To use the Service, you must be at least 18 years of age and legally capable of entering into binding contracts. You agree to provide accurate, current, and complete information in all inquiries and communications, and to update information as necessary to keep it accurate. Submitting false or misleading information is prohibited.

5. Your Consent to Be Contacted

By submitting a financing inquiry and checking the consent box presented on the form, you provide your prior express written consent for us and one or more participating lenders to contact you at the phone number and email address you provided, including by autodialer, prerecorded or artificial voice, SMS/text message, and email, regarding your financing inquiry. You understand that your information will be shared with one or more participating lenders who may contact you. Consent is not a condition of receiving any services or obtaining a loan. Message and data rates may apply. Message frequency varies. You may opt out at any time by replying STOP to any text or calling 843-287-9930. A current list of participating lenders is available upon request.

6. Equal Opportunity

Hard Money Lenders of Myrtle Beach connects borrowers with lenders who are Equal Opportunity Lenders. Participating lenders do not discriminate on the basis of race, color, religion, national origin, sex, familial status, disability, marital status, or age.

7. Acceptable Use

You agree that you will not:

• Use the Site for any unlawful purpose or in violation of any applicable law or regulation;
• Submit false, misleading, or fraudulent information;
• Impersonate any person or entity or misrepresent your affiliation with any person or entity;
• Access or attempt to access the Site or related systems using automated means (including scrapers, bots, or harvesters) except as expressly permitted by us;
• Interfere with, disrupt, or attempt to gain unauthorized access to the Site, our servers, or any networks connected to the Site;
• Use the Site to send unsolicited commercial communications or to harass any person.

8. Intellectual Property

The Site and all content made available through it — including text, graphics, logos, images, audio, video, and software — are owned by Lead Skills, LLC or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, or otherwise exploit any content from the Site without our prior written consent, except as expressly permitted by these Terms or applicable law.

9. Third-Party Links and Services

The Site may contain links to, or descriptions of, third-party websites, products, or services, including those of participating lenders. We do not control, operate, or endorse any third-party site or service, and we are not responsible for their content, accuracy, availability, privacy practices, or policies. Your interactions with any participating lender or other third party are solely between you and that third party and are governed by their terms and policies.

10. Disclaimers

THE SITE AND SERVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, Lead Skills, LLC DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED. WE DO NOT WARRANT THAT YOU WILL BE MATCHED WITH A LENDER, RECEIVE A LOAN OFFER, OR OBTAIN FINANCING ON ANY PARTICULAR TERMS.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, Lead Skills, LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SITE OR SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

12. Indemnification

You agree to defend, indemnify, and hold harmless Lead Skills, LLC and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site or Service, your violation of these Terms, your violation of any law, or your interactions with any participating lender or other third party.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of South Carolina, without regard to its conflict-of-laws rules. Any action or proceeding arising out of or related to these Terms or the Service must be brought exclusively in the state or federal courts located in Horry County, South Carolina, and you consent to the personal jurisdiction of those courts.

14. Changes to These Terms

We may modify these Terms at any time. When we do, we will post the updated Terms on this page and revise the "Last Updated" date above. Material changes will take effect upon posting (or as otherwise required by law). Your continued use of the Site after the effective date constitutes your acceptance of the revised Terms.
